TERMS & CONDITIONS FOR FARM STAYS

Standard Terms and Conditions
These are the Terms and Conditions that apply to any products and/or services purchased in relation to a Farm Stay hosted by or on behalf of Bilston Creek Farm (“Bilston”), and govern the contractual relationship between you and Bilston with respect to those products and/or services, including but not limited to weekend reservations at Bilston, purchased through Bilston’s website (hereinafter, the “Farm Stay” or “Farm Stays”).
By booking a Farm Stay you accept these Terms and Conditions and should read them carefully before making a booking. We recommend you save a copy of them for your future reference.
1. The Farm Stay
1.1. In the interest of all our guests, and in accordance with provincial and/or federal regulations, you acknowledge that admission to Bilston Creek Farm for a Farm Stay may be subject to certain safety and/or security checks. The following items may not under any circumstance be brought onto the venue: explosive substances or materials, pyrotechnics, offensive weapons and firearms (including replica or toy firearms), projectiles and similar devices; spray paint; alcohol; illicit drugs; or any other items which in our opinion pose a health and safety risk to, or affect the enjoyment of, the other visitors in any way (“Prohibited Items”). You may not be permitted to enter the venue, or may be ejected from it, without refund, if you violate these Terms and Conditions. You acknowledge that additional terms and/or restrictions may apply to the Farm Stays from time to time, and that you are responsible to check the relevant event description for details of any additional terms or restrictions before making a booking. You also promise that you, and anyone on whose behalf you book an Farm Stay, will observe and comply with any such terms or restrictions.
1.2. Maximum two people per tent.
1.3. When you purchase a Farm Stay on this website you are making an application to us to attend that Farm Stay. Our acceptance of your booking will take place when you receive an email confirmation of your booking. Bilston reserves the right to refuse an application for attendance.
1.4. In order to get the most from the Farm Stay please ensure that you arrive within the stated check in hours.
1.5. Late arrivals must be communicated to Bilston Creek Farm staff in advance, and self checkin will be coordinated.
1.6. Bilson reserves the right to request that any person leave a Farm Stay if that person’s conduct is unacceptable (in our reasonable opinion). No refund of fees or any other costs will be made in these circumstances.
1.7. You acknowledge that the details of the Farm Stay are subject to reasonable changes. Existing customers will be alerted via email if changes are made.
1.8. We will send an email confirmation of your booking to the email address you provide shortly after we accept your booking. It is your responsibility to ensure that the email address you provide to us is valid.
1.9. Farm Stay reservation bookings must not be resold or passed on for personal or commercial gain.
1.10. The unauthorized use of photographic and recording equipment for any commercial purpose is prohibited at our Farm Stays. Restrictions on items which may be taken onto the property may also apply. You are advised to check the Farm Stay booking page on our website for any such restrictions before booking.
1.11. Pets are not allowed on Bilston property.
2. Fees
2.1. When booking a Farm Stay, full payment of the fees and security/damage deposit is required at the time that we accept your booking.
2.2. Details of the fees for each Farm Stay will be set out on the Bilston website. 5% GST will be added to Farm Stays at the time of booking online, and is subject to change. Price changes will not affect bookings that have already been confirmed.
2.3. Payments can be made on the Bilston website using most major credit and debit cards, including Shop Pay, and Google Pay. If necessary, please email us at info@bilston.ca to inquire about alternative forms of payment.
2.4. A limited number of booking reservations are available for Farm Stays. Reservations are sold on a first-come-first-served basis.
2.5. The security/damage deposit, less amounts owing for cost to repair/replace damage, if any, caused by the Farm Stay guest will be returned 5-7 days after departure.
3. Refunds and Cancellations
3.1. No refunds will be given for cancellations less than 48 hours prior to the arrival date.
3.2. A full refund, less a 10% administration fee, will be offered for cancellations that occur between 3 – 5 days prior to the arrival date.
3.3. A full refund will be offered if reservation is cancelled more than 5 days prior to arrival date.
3.4. The cleaning fee will be refunded if reservation is cancelled.
3.5. A 10% administration fee will apply to all requests to reschedule Farm Stay bookings.
3.6. In case of inclement weather, Farm Stay bookings may be cancelled, or rescheduled to another available date:
- A 10% administration fee will be applied if you choose to cancel your booking
- No additional fees apply if you choose to reschedule to another available date
3.7. Bilston Creek Farm has the right to close due to inclement weather, and every reasonable effort will be made to contact those who may be affected by the closure. A staff member will contact you to arrange rescheduling of your Farm Stay booking, or a full refund will be offered.
3.8. If you do not attend the Farm Stay (no-show), you will not be entitled to a refund.
3.9. Bilston reserves the right to cancel any Farm Stay at any time prior to its commencement. Bilston will not be responsible for any extra costs incurred as a result of a cancelled or rescheduled Farm Stay.
3.10. There is no entitlement to a refund where Bilston is forced to cancel part or all of an Farm Stay due to reasons beyond our reasonable control.
3.11. Please email info@bilston.ca or call 778-533-7550 if you would like to cancel or reschedule a Farm Stay booking.
4. Farm Stay Etiquette
4.1. Check-in hours are between 1:00pm and 4:00pm on your arrival day. Please contact info@bilston.ca or call 778-533-7550 if you plan to arrive outside of those hours. Early check-in may be requested however not guaranteed.
4.2. Check-out time is no later than 11:00am on Tuesday or Wednesday. Late check-out will result in a deduction from the security deposit.
4.3. Maximum two guests per tent.
4.4. Outside guests are not permitted to stay past public hours or overnight.
4.5. If additional cleaning is required, a reasonable fee will be deducted from the security deposit paid at the time of booking.
4.6. Food is not permitted inside tents (to prevent attracting wildlife). A shared fridge is available at the Orchard Pub for food and beverage storage if required. It is the responsibility of each guest to label their own food items if using the shared fridge and remove it at the end of their stay.
4.7. Candles, fire and open flame of any kind are not permitted on Bilston property.
4.8. Quiet time is between the hours of 9:00pm and 7:00am.
4.9. Bilston Creek Farm is a 100% smoke free environment. Smoking is not permitted anywhere on the property.
4.10. Bilson reserves the right to request that any person leaves a Farm Stay if that person’s conduct is unacceptable (in our reasonable opinion). No refund of fees or any other costs will be made in these circumstances. If a noise complaint is received as the result of guest conduct, fines will be passed on to the responsible guest by way of deduction from security deposit.
4.11. Pets are not allowed.
5. Feedback and Complaints
5.1. Bilston Farm Stays are designed to provide an enjoyable and high-quality experience for those attending. If you would like to submit a formal complaint in regards to a Farm Stay, please email info@bilston.ca with the subject “Farm Stay Complaint”. You are advised to make your complaint within 14 days of the Farm Stay so that we might be able to rectify the situation more easily. Please note, we take complaints very seriously and will aim to investigate and respond to any complaint as quickly as possible.
6. Our Liability to You
6.1. Nothing excludes or limits Bilston’s liability for personal injury or death due to its own negligence. You have certain rights under the law, for example that we will provide the Farm Stay with reasonable care and skill. Nothing in these terms will affect those rights.
6.2. Please ensure that you take care of your personal possessions during your Farm Stay. Bilston cannot accept any liability for your personal possessions unless the loss or damage is caused by our own negligence.
6.3. Except as stated in section 6.1, we are not responsible for: (i) losses not caused by our breach; (ii) indirect losses, which means loss to you that is a side effect of the main loss or damage and where we could not have reasonably anticipated that type of loss arising at the time of entering into these Terms and Conditions; (iii) failure to meet any of our obligations where such failure is due to events beyond our control; or (iv) any increase in any loss or damage which results from breach by you of any of these Terms and Conditions or your negligence.
6.4. Except as stated in section 6.1, Bilston’s total liability to you is limited to the fees you have actually paid for the relevant Farm Stay, and Bilson is not liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, accommodation or hospitality relating to a Farm Stay that have been arranged by you are done so at your own risk.
6.5. You are responsible for any cost associated with your transport to and from a Farm Stay, as well as other costs not specifically included in the price of the Farm Stay, including but not limited to drinks, snacks and meals that are not paid by you in advance or included in the price of the Farm Stay.
7. Data Protection
7.1. To process your booking, we may need to use the information you provide and pass it on to other relevant suppliers who are responsible for parts of the Farm Stay. By booking your Farm Stay, your consent to this information being passed on to the relevant persons is deemed to be given unless you object and advise Bilston of your objection at the time of booking. The information may also be provided to public authorities such as customs or immigration if required by them, or as otherwise required by law. This consent applies to any sensitive information that you give to us, including but not limited to details of any disabilities or dietary/religious requirements.
8. General Terms
8.1. These Terms and Conditions are a contract between you and Bilston Creek Farm. No other person shall have any right to enforce any of these Terms and Conditions.
8.2. Each section of this Terms and Conditions agreement operates independently from the others. If a court or relevant authority and jurisdiction finds one of the sections in these Term and Conditions to be unlawful, the remaining sections will remain in full force and effect.
8.3. We may revise these Terms and Conditions from time to time, for example to reflect changes in relevant laws or regulatory requirements or improvements that we make to the Attractions and related services.
8.4. This Agreement will be construed and enforced in accordance with the laws of the Province of British Columbia.
