Standard Terms and Conditions

These are the Terms and Conditions that apply to any products and/or services purchased in relation to a live public attraction hosted by or on behalf of Bilston Creek Farm (“Bilston”), and govern the contractual relationship between you and Bilston with respect to those products and/or services, including but not limited to weekend reservations at Bilston, and any other farm-Hosted Attraction purchased through Bilston’s website (hereinafter, the “Attraction” or "Attractions").
By booking an Attraction you accept these Terms and Conditions and should read them carefully before making a booking. We recommend you save a copy of them for your future reference.
1. The Attractions
1.1. In the interest of all our guests, and in accordance with provincial and/or federal regulations, you acknowledge that admission to any Attraction may be subject to certain safety and/or security checks including but not limited to health safety checks or questionnaires prior to your entering the venue. The following items may not under any circumstance be brought onto the venue: explosive substances or materials, pyrotechnics, offensive weapons and firearms (including replica or toy firearms), projectiles and similar devices; spray paint; alcohol; illicit drugs; or any other items which in our opinion pose a health and safety risk to, or affect the enjoyment of, the other visitors in any way (“Prohibited Items”). You may not be permitted to enter the venue, or may be ejected from it, and required to surrender any tickets you hold without refund, if you violate these Terms and Conditions. You acknowledge that additional terms and/or restrictions may apply to the Attractions from time to time, and that you are responsible to check the relevant event description for details of any additional terms or restrictions before making a booking. You also promise that you, and anyone on whose behalf you book an Attraction, will observe and comply with any such terms or restrictions.
1.2. When you purchase an Attraction on this website you are making an application to us to attend that Attraction. Our acceptance of your booking will take place when you receive an email confirmation of your booking. Bilston reserves the right to refuse an application for attendance.
1.3. In order to get the most from the Attraction, please ensure that you arrive promptly at the scheduled start time or in accordance with your selected reservation time.
1.4. Bilson reserve the right to request that any person leaves an Attraction if that person’s conduct is unacceptable (in our reasonable opinion). No refund of fees or any other costs will be made in these circumstances.
1.5. You acknowledge that the scheduled time and/or details of any Attraction is subject to reasonable changes. Existing customers will be alerted via email if changes are made.
1.6. We will send an email confirmation of your booking to the email address you provide shortly after we accept your booking. It is your responsibility to ensure that the email address you provide to us is valid.
1.7. Except as permitted by section 3.2 below, Attraction reservation bookings are non-transferable and must not be resold or passed on for commercial gain.
1.8. The unauthorized use of photographic and recording equipment for any commercial purpose is prohibited at our Attractions. Restrictions on items which may be taken onto the property may also apply (e.g. your own food and drink). You are advised to check the Attraction booking page on our website for any such restrictions before booking.
2.1. When booking an Attraction, full payment of the fee is required at the time that we accept your booking.
2.2. Details of the fees for each Attraction will be set out on the Bilston website and the booking page. Attraction pricing may include GST and/or PST, and are subject to change. Price changes will not affect bookings that have already been confirmed.
2.3. Payments can made on the Bilston website using most major credit and debit cards, including Apple Pay, Shop Pay, and Google Pay. If necessary, please email us at firstname.lastname@example.org to inquire about alternative forms of payment.
2.4. A limited number of booking reservations are available for most Attractions. Reservations are sold on first-come-first-served basis.
3. Refunds and Cancellations
3.1. If you choose to cancel, you must provide Bilston with written notice 24 hours in advance of the Attraction to receive a refund. Unless otherwise addressed in an announcement or update at the top of this webpage, requests for cancellations with less than 24 hours notice will not be refunded. You can submit a cancellation request to email@example.com.
3.2. If you do not to attend the Attraction you booking fee will not be refunded, but you may transfer your booking to another person by passing on your original ticket. We request that you notify us of the details of any transfer by sending an email to firstname.lastname@example.org.
3.3. Bilston reserves the right to cancel any Attraction at any time prior to its commencement. Except as set out in 4.5 below, Bilston will refund existing customers the full price of their booking. Bilston will not be responsible for any extra costs incurred as a result of a cancelled or rescheduled event.
3.4. There is no entitlement to a refund where Bilston is forced to cancel part or all of an Attractions due to reasons beyond our reasonable control. However, refunds may be given at our discretion.
3.5. We regret Bilston cannot offer refunds if/when we have to make reasonable changes as described in section 2.5 above.
4. Feedback and Complaints
4.1. Bilston Attractions are designed to provide an enjoyable and high-quality experience for those attending. If you would like to submit a formal complaint in regard an Attraction, please email email@example.com with the subject “Attraction Complaint”. You are advised to make your complaint within 14 days of the Attraction so that we might be able to rectify the situation more easily. Please note, we take complaints very seriously and will aim to investigate and respond to any complaint as quickly as possible.
5. Our Liability to You
5.1. Nothing excludes or limits Bilston’s liability for personal injury or death due to its own negligence. You have certain rights under the law, for example that we will provide the Attraction with reasonable care and skill. Nothing in these terms will affect those rights.
5.2. Please ensure that you take care of your personal possessions while attending an attraction. Bilston cannot accept any liability for your personal possessions unless the loss or damage is caused by our own negligence.
5.3. Except as stated in section 5.1, we are not responsible for: (i) losses not caused by our breach; (ii) indirect losses, which means loss to you that is a side effect of the main loss or damage and where we could not have reasonably anticipated that type of loss arising at the time of entering into these Terms and Conditions; (iii) failure to meet any of our obligations where such failure is due to events beyond our control; or (iv) any increase in any loss or damage which results from breach by you of any of these Terms and Conditions or your negligence.
5.4. Except as stated in section 5, Bilston’s total liability to you is limited to the fees you have actually paid for the relevant Attraction, and Bilson is not liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, accommodation or hospitality relating to an Attraction that have been arranged by you are done so at your own risk.
5.5. You are responsible for any cost associated with your transport to and from an Attraction, as well as other costs not specifically included in the price of the Attraction, including but not limited to drinks, snacks and meals that not paid by you in advance or included in the price of the Attraction.
6. Data Protection
6.1. To process your booking, we may need to use the information you provide and pass it on to other relevant suppliers who are responsible for parts of the Attraction. By booking your Attraction, your consent to this information being passed on to the relevant persons is deemed to be given unless you object and advise Bilston of your objection at the time of booking. The information may also be provided to public authorities such as customs or immigration if required by them, or as otherwise required by law. This consent applies to any sensitive information that you give to us, including but not limited to details of any disabilities or dietary/religious requirements.
7. General Terms
7.1. These Terms and Conditions are a contract between you and Bilston. No other person shall have any right to enforce any of these Terms and Conditions.
7.2. Each section of this Terms and Conditions agreement operates independently from the others. If a court or relevant authority and jurisdiction finds one of the sections in these Term and Conditions to be unlawful, the remaining sections will remain in full force and effect.
7.3. We may revise these Terms and Conditions from time to time, for example to reflect changes in relevant laws or regulatory requirements or improvements that we make to the Attractions and related services.
7.4. This Agreement will be construed and enforced in accordance with the laws of the Province of British Columbia.
